用人單位違法解除或者終止勞動合同幾倍賠償?
單方解除勞(lao)動(dong)(dong)合(he)同,違法(fa)解除的,按經濟補償的二倍(bei)進行(xing)補償。雙倍(bei)賠(pei)償的前提是用(yong)人(ren)單位違法(fa)解除或終止勞(lao)動(dong)(dong)合(he)同,也就是說,如(ru)果屬于(yu)用(yong)人(ren)單位違法(fa)解除勞(lao)動(dong)(dong)合(he)同,勞(lao)動(dong)(dong)者可以要求用(yong)人(ren)單位支付雙倍(bei)的補償金(jin)。

第(di)十(shi)二條 勞動(dong)(dong)(dong)合(he)同(tong)分為固定期限勞動(dong)(dong)(dong)合(he)同(tong)、無固定期限勞動(dong)(dong)(dong)合(he)同(tong)和(he)以(yi)完(wan)成(cheng)一定工作任務為期限的勞動(dong)(dong)(dong)合(he)同(tong)。
第十三(san)條 固定期限(xian)勞(lao)動合(he)同,是(shi)指用人單位與勞(lao)動者約(yue)定合(he)同終止時間的勞(lao)動合(he)同。
用人(ren)單位與勞(lao)動者(zhe)協商(shang)一致(zhi),可(ke)以(yi)訂立(li)固定期(qi)限(xian)勞(lao)動合同。
第十(shi)四(si)條 無固定期限勞(lao)動合同,是指(zhi)用人單位與勞(lao)動者(zhe)約(yue)定無確定終止時(shi)間的勞(lao)動合同。
用人單位與勞(lao)動(dong)者協(xie)商一(yi)致,可以訂(ding)立無固(gu)定(ding)期(qi)限勞(lao)動(dong)合(he)同。有下(xia)列(lie)情形(xing)之一(yi),勞(lao)動(dong)者提出(chu)或者同意續訂(ding)、訂(ding)立勞(lao)動(dong)合(he)同的,除勞(lao)動(dong)者提出(chu)訂(ding)立固(gu)定(ding)期(qi)限勞(lao)動(dong)合(he)同外,應當(dang)訂(ding)立無固(gu)定(ding)期(qi)限勞(lao)動(dong)合(he)同:
(一)勞動者在該(gai)用人單位(wei)連續(xu)工(gong)作滿十年(nian)的;
(二)用人(ren)單位(wei)初次實行勞動合同(tong)制度或者(zhe)國(guo)有企業改制重新(xin)訂立勞動合同(tong)時(shi),勞動者(zhe)在該用人(ren)單位(wei)連續工(gong)作滿(man)十(shi)(shi)年且距(ju)法(fa)定退休年齡不(bu)足十(shi)(shi)年的(de);
(三(san))連續(xu)訂(ding)立二次固定期限勞(lao)動合(he)同,且勞(lao)動者(zhe)沒有本(ben)法第(di)三(san)十(shi)九條和(he)第(di)四(si)十(shi)條第(di)一項(xiang)、第(di)二項(xiang)規(gui)定的情(qing)形,續(xu)訂(ding)勞(lao)動合(he)同的。
用人(ren)單(dan)位(wei)自(zi)用工之(zhi)日起(qi)滿一年(nian)不與勞(lao)(lao)動(dong)(dong)(dong)者訂立書(shu)面(mian)勞(lao)(lao)動(dong)(dong)(dong)合同的(de),視為用人(ren)單(dan)位(wei)與勞(lao)(lao)動(dong)(dong)(dong)者已訂立無固定期(qi)限勞(lao)(lao)動(dong)(dong)(dong)合同。
第十五條(tiao) 以(yi)完成一(yi)定工(gong)作(zuo)任務為(wei)期限(xian)(xian)的(de)勞(lao)動(dong)合同,是指用人單位與勞(lao)動(dong)者約定以(yi)某項工(gong)作(zuo)的(de)完成為(wei)合同期限(xian)(xian)的(de)勞(lao)動(dong)合同。
用人單位與勞動者協(xie)商一致(zhi),可以訂立以完成一定工作任務為期限(xian)的勞動合同(tong)。
第五章 特別規定
第一節集體合同
第五十(shi)一條 企(qi)業(ye)職(zhi)工一方與用(yong)人(ren)單位通過平等協商,可以就勞(lao)動報酬(chou)、工作時(shi)間、休(xiu)(xiu)息休(xiu)(xiu)假、勞(lao)動安(an)全衛生、保險(xian)福利等事項訂(ding)立集(ji)體(ti)合同(tong)。集(ji)體(ti)合同(tong)草案(an)應當提(ti)交職(zhi)工代表大(da)會(hui)或者全體(ti)職(zhi)工討論通過。
集體合(he)同(tong)由(you)工會代表企(qi)業職工一方與用人單(dan)位訂立;尚未(wei)建立工會的用人單(dan)位,由(you)上級工會指導(dao)勞動者(zhe)推舉的代表與用人單(dan)位訂立。
第二節勞務派遣
第(di)五十(shi)八條(tiao) 勞(lao)務派遣(qian)單(dan)位(wei)是本法所稱用人(ren)單(dan)位(wei),應當(dang)履行用人(ren)單(dan)位(wei)對勞(lao)動(dong)者的義務。勞(lao)務派遣(qian)單(dan)位(wei)與被(bei)派遣(qian)勞(lao)動(dong)者訂立的勞(lao)動(dong)合(he)同(tong),除應當(dang)載明本法第(di)十(shi)七條(tiao)規(gui)定的事(shi)項外,還應當(dang)載明被(bei)派遣(qian)勞(lao)動(dong)者的用工(gong)單(dan)位(wei)以及派遣(qian)期限、工(gong)作崗位(wei)等情況。
勞(lao)(lao)務派(pai)遣單位應當與被派(pai)遣勞(lao)(lao)動(dong)者訂立(li)二年以上的固定期限勞(lao)(lao)動(dong)合(he)同,按月支(zhi)付(fu)勞(lao)(lao)動(dong)報酬;被派(pai)遣勞(lao)(lao)動(dong)者在無工作(zuo)期間,勞(lao)(lao)務派(pai)遣單位應當按照所在地人(ren)民政府(fu)規定的最(zui)低工資標準,向其(qi)按月支(zhi)付(fu)報酬。
第三節非全日制用工
第六(liu)十(shi)八條 非全日制用(yong)(yong)工,是指以(yi)小時(shi)(shi)(shi)(shi)計酬為主(zhu),勞動者(zhe)在同一用(yong)(yong)人單位一般(ban)平均每(mei)日工作時(shi)(shi)(shi)(shi)間不(bu)超(chao)過(guo)四小時(shi)(shi)(shi)(shi),每(mei)周工作時(shi)(shi)(shi)(shi)間累計不(bu)超(chao)過(guo)二十(shi)四小時(shi)(shi)(shi)(shi)的用(yong)(yong)工形式。
第六十九條 非全日(ri)制(zhi)用工雙方當事人可(ke)以訂(ding)立口頭協(xie)議。
從事非全日(ri)制用(yong)工(gong)的(de)勞動者可以(yi)與一(yi)(yi)個(ge)或者一(yi)(yi)個(ge)以(yi)上用(yong)人單位訂立(li)勞動合(he)同(tong);但(dan)是,后訂立(li)的(de)勞動合(he)同(tong)不得影響先訂立(li)的(de)勞動合(he)同(tong)的(de)履行。
根據不(bu)(bu)同(tong)的(de)(de)劃分(fen)(fen)方式,勞動合同(tong)可以劃分(fen)(fen)為不(bu)(bu)同(tong)的(de)(de)類別(bie)。不(bu)(bu)過不(bu)(bu)管是哪一種勞動合同(tong),該填寫的(de)(de)內容必須要有,如果缺失重要信息(xi),都可能導致合同(tong)失效。員工在簽訂勞動合同(tong)的(de)(de)時候一定要仔(zi)細的(de)(de)閱讀合同(tong)內容,比如缺少違約金(jin)或者工資的(de)(de)話,在日后產生糾紛的(de)(de)時候是非常吃虧的(de)(de)。
勞動合同中有哪些條款必須寫清楚?
(一)用人(ren)單(dan)位(wei)的(de)名(ming)稱、住所、法(fa)定(ding)代表(biao)人(ren)或者是主要(yao)負責人(ren)的(de)姓名(ming)。
(二)勞動者(zhe)的(de)姓名(ming)還有(you)住址,居民身份(fen)證或者(zhe)其他有(you)效(xiao)身份(fen)證件(jian)號碼。
(三)勞(lao)(lao)動合(he)(he)同(tong)的(de)期(qi)限(xian)。合(he)(he)同(tong)期(qi)限(xian)主要分(fen)為固(gu)定期(qi)限(xian)、無(wu)(wu)固(gu)定期(qi)限(xian)以(yi)及完(wan)成一定工作(zuo)任憑為期(qi)限(xian),如果(guo)是臨(lin)時性(xing)工作(zuo)的(de)人,勞(lao)(lao)動合(he)(he)同(tong)中(zhong)必須得(de)明確。如果(guo)沒有明確期(qi)限(xian)應該視為無(wu)(wu)固(gu)定期(qi)限(xian)。不(bu)論簽一年(nian)、兩(liang)年(nian)或(huo)三年(nian),都必須有起止日(ri)期(qi)。
(四)工作內容和(he)工作地點。工作內容應該體現在勞動合同中,比如從(cong)事(shi)的(de)崗位,具體負責內容。工作地點也很(hen)重(zhong)要(yao),勞動合同中必須規定勞動地點,否則很(hen)容易產生糾(jiu)紛。
(五)勞動(dong)報(bao)酬(chou)。這對于每個勞動(dong)者(zhe)都(dou)是(shi)非常重(zhong)要的(de)(de)也是(shi)比較關心的(de)(de),勞動(dong)報(bao)酬(chou)應該(gai)明確(que)的(de)(de)寫在(zai)勞動(dong)合同中。而且也需要明確(que)加班費的(de)(de)計算基(ji)數、獎(jiang)金、津貼、補貼的(de)(de)數額以及(ji)支付(fu)時間、支付(fu)方式等(deng)(deng)等(deng)(deng)。
(六)社會保(bao)(bao)險(xian)(xian)。國家規定用(yong)人單(dan)位必(bi)須為員工(gong)繳納社會保(bao)(bao)險(xian)(xian),即是我們通常說的五險(xian)(xian),其中包括(kuo)養老(lao)保(bao)(bao)險(xian)(xian)、失業(ye)保(bao)(bao)險(xian)(xian)、醫療保(bao)(bao)險(xian)(xian)、工(gong)傷保(bao)(bao)險(xian)(xian)、生育保(bao)(bao)險(xian)(xian)。
